Marathon Restorations provides exterior home services, which may include roofing, gutters, siding, decks, windows, and storm restoration. The specific services, materials, and timeline for your project will be set out in your written estimate or service agreement, which together with these Terms forms the complete agreement between us.
Scheduling, Access, and Weather
Because our work is performed outdoors, project timelines are estimates and may be affected by weather, material availability, permitting, and other factors beyond our control. You agree to provide safe and reasonable access to the work areas of your property. We will make reasonable efforts to keep you informed of any changes to your schedule.
Payment
Payment terms will be set out in your written estimate or service agreement. Unless otherwise stated in writing, invoices are due upon completion of the work described. We reserve the right to suspend work on accounts that are past due.
Warranties
Any workmanship warranty offered by Marathon Restorations, and its duration, will be stated in your written service agreement. Materials such as roofing, siding, decking, and windows may also carry separate warranties issued directly by their manufacturers; those manufacturer warranties are governed by the manufacturer’s own terms, not by Marathon Restorations. We make no warranties beyond those expressly provided in writing.
Insurance Claims and Storm Restoration
For storm and insurance-related work, Marathon Restorations may assist you in documenting damage, but we do not act as your insurance adjuster or provide legal or insurance advice. Whether a loss is covered, and the amount of any payment, is determined solely by your insurance carrier and the terms of your policy. You remain responsible for any deductible and for amounts not covered by your insurer.
Property and Site Conditions
You represent that you own the property, or are authorized to approve work on it, and that you have disclosed known conditions that could affect the work. Marathon Restorations is not responsible for pre-existing conditions, defects, or code issues that are not part of the agreed scope of work.
Limitation of Liability
To the fullest extent permitted by law, Marathon Restorations will not be liable for any indirect, incidental, or consequential damages arising out of your use of the Website or our services. Our total liability for any claim relating to a project is limited to the amount you paid for that project. Nothing in these Terms limits liability that cannot be limited under applicable law.
